DO NOT WAIT

If any employer or governmental entity is involved, a notice of claim is required within either 60 days (or 6 months with state suits).Your claim may be lost forever if a complaint is not properly filed within two (2) years of your accident or five (5) years from the date of your industrial injury (one year if the carrier denied any benefits).

INJURED PARTIES BEWARE

The first thing you should know or have already realized is that the insurance company or adjuster is not on your side. They are compensated based on how little they pay you. The insurance company's profit and shareholders bank or depend on paying you less than you deserve. They play it like a game but it is not entertaining. It’s really a war and you need an experienced litigator like us to fight for what is right for you.

MEDICAL TREATMENT

Do not be a hero. Visit your doctor immediately to document your injury as well as receive medical treatment. Follow doctor’s orders. See specialists if you are given a referral or need more extensive treatment. See chiropractors as directed, but combine that with treatment from regular medical doctors because courts will not accept an opinion from any one but a medical doctor on the issue of whether the accident or industrial injury is the cause of your medical problem. Remember if you do not seek treatment or follow doctor’s orders, the insurance company will say to the jury you are not hurt or failing to follow doctor’s directions is why you are hurt and it is not the fault of the person or company who injured you.

LEGAL PROCESS

We assemble your medical records. We employ experts to help evaluate and prove your case. We have knowledge of juries and anticipated damage awards if trial becomes necessary. Most cases settle at meditation out of court before or after the suit depending on the insurance company or the facts of the case. Every case is unique. Having an advocate to champion your cause is essential to a fair recovery (just compensation), avoiding unnecessary pitfalls and preventing the adjuster from taking advantage of you.
