Important Notices
You have sixty days to report your job accident to your employer, the Industrial Commission and the insurance carrier. This notice must be in writing. Your employer has the forms as does our office, the Industrial Commission, or insurance company which insures the employer.
However, if you are hurt on the job, you should tell your supervisor immediately and ask for the company to report this accident.
Statute of Limitations
- If your employer or it's carrier denies any insurance coverage you must file a complaint with the Industrial Commission within one (1) year from the date of the accident or five (5) years if they discontinue benefits.

General Benefits
If you have been hurt on the job, you have the following benefits regarding physical or mental injuries arising from your industrial accident:
- Reasonable medical treatment with no deductible or contribution from you.
- Temporary wages at two-thirds your normal wage or the average state weekly wage if your treating physician orders you not to work while you recover.
- Impairment award if your body or mind has permanently changed as a result of your industrial injury.
- Disability benefits if the permanent physical or mental changes negatively affect or decrease your employability or ability to make a living in the way you could have before your industrial accident.
- Retraining benefits as an alternative or in addition to disability benefits.
Immediate medical care
If the injury is not minor or is not treatable by a first aid kit with proper antiseptic cleansing, then you should immediately seek medical treatment. If it is an emergency, go to the closest emergency room. If not call your employer’s comp insurance carrier for a referral to a doctor or medical provider which they approve.
Course of Medical Treatment
- Follow doctors orders to the letter or the insurance carrier will claim you and not your accident caused your continuing medical condition.
- Follow up with all medical recommendations and attend all appointments or the insurance carrier will claim you are not cooperating and terminate your benefits.
- Remember, the insurance carrier is looking for any way to terminate your benefits and let them off the hook.
